Givly is an application a merchant installs on their OpoShop store. It adds a control to the storefront that lets a shopper add a donation — a round-up to the next whole unit of currency, or a set amount — to the order they are already buying, and it gives the merchant a ledger and a report of those donations.
Givly is not a payment processor, a money transmitter, a charity, or a fundraising platform, and it does not move money. An installed OpoShop app cannot charge a card or make a payout. The donation is collected by the merchant, through the merchant's own checkout, and arrives in the merchant's own payout alongside the rest of the order.
Givly's role is limited to calculating the amount, adding it to the cart as a line the merchant's store prices, and reporting what was collected. Passing the money to the named cause is entirely the merchant's responsibility.

Givly's ledger is built by re-reading the merchant's real orders from OpoShop. Figures are reported as collected, net of any discount applied to the donation line, and only for orders in a status that means the merchant has been paid. We make every reasonable effort to keep these figures correct, but the merchant remains responsible for reconciling them against their own OpoShop records before relying on them.
Givly creates one unlisted product on the merchant's store, which exists solely so a donation has something for the store to price. Givly only ever modifies products it created itself. Deleting that product from the store will stop donations working until it is rebuilt from Givly's settings page.
Givly is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation. We may change, suspend or discontinue any part of the service, and will give reasonable notice of a material change where we can.
To the maximum extent permitted by law, Found's total liability arising out of or relating to Givly is limited to the fees paid for Givly in the twelve months before the claim. We are not liable for indirect, incidental, special or consequential losses, or for lost profits or lost goodwill. Nothing in these terms excludes liability that cannot lawfully be excluded.
A merchant may uninstall Givly at any time from their OpoShop admin; the storefront control stops immediately. We may suspend access where use of Givly is unlawful, or where donations are being solicited under a description we have reason to believe is false.
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules.
